Recently, the California Employment Development Department (EDD) updated a required California workplace poster — EDD Notice to Employees (DE 1857A). The revised notice is dated May 2018 but was published in July 2018.

The EDD informed the California Chamber of Commerce that, while maintaining updated publications is always encouraged, employers can continue to use the previous version of DE 1857A until January 1, 2019, at which time all employers must post the updated version.

In other words, it is not mandatory to replace this poster until next year.

The EDD recognizes that employers generally replace required notices and pamphlets at the beginning of the year when many changes may go into effect.

Employers subject to both the state’s unemployment insurance and disability insurance programs are required to post DE 1857A in a prominent location where employees can easily see it. Required by California law (UI Code § 1089), this notice provides workers with information regarding unemployment insurance, state disability insurance and paid family leave.

In addition, the EDD recently updated a required pamphlet, For Your Benefit: California’s Program for the Unemployed, (DE 2320 (4/2018)). Whenever a California employee is terminated, laid off or takes a leave of absence, employers must provide them with this pamphlet. Again, the EDD stated that employers can continue to use previous versions of this pamphlet until January 1, 2019.

Most of the changes to the poster and pamphlet relate to the EDD’s transition away from the eApplyI system into the more streamlined UI Online and SDI Online systems for applicants, which can be accessed easily through the single login site – Benefits Programs Online. Other changes made keep the information on the notice and the pamphlet current.
