Updated COBRA Notices Available

The White House recently updated model notices informing workers of their eligibility to continue health care coverage through the Consolidated Omnibus Budget Reconciliation Act (COBRA).

The updates were made to add language informing workers that if they are eligible for COBRA continuation coverage when leaving a job, they may choose to instead purchase coverage through the federal Health Insurance Marketplace.

Other revisions were made to the notices, but they are more technical in nature.

The following model notices were updated:

  • COBRA Continuation Coverage General Notice
  • COBRA Continuation Coverage Election Notice

The DOL published frequently asked questions (FAQs) related to the model notices on its website and issued a notice of proposed rulemaking to update its regulations with respect to the model COBRA notices.

The regulations have not been updated, but employers should begin using the updated notices now. “Until rulemaking is finalized and effective, DOL will consider use of the model notices available on its website, appropriately completed, to constitute compliance with the notice content requirements of COBRA,” according to a DOL statement.
